5 Year Old Boy Locked In Room and Forgotten By Teacher

  A five year old boy was allegedly locked in a small room by his kindergarten teacher. The parents state that the room was dark and that the boy had been locked in the room for over an hour. Out of fear the boy was crying and had urinated on himself. The boy wasn't discovered until the parents went to the school to search for him because he was over 45 minutes late from returning home.

   As reported by msn.com, the Idaho school district in Caldwell does not deny that the teacher did in fact put the boy in the small room as a form of discipline. It is unclear what action by the boy prompted such discipline and the school is not revealing that citing student privacy. However, the school district states that the discipline actions taken by the teacher were not appropriate. The school district does dispute the allegations that the room was locked and that it was dark, but do not deny that the boy was placed in there and then forgotten for over an hour.

   At this time, it is unclear what actions the school district is taking against the teacher and to ensure that such an incident does not occur again. The school district has permitted the young boy to move to a different kindergarten teacher.

Organic Peanut Butter Factory Shut Down After Numerous People Infected with Salmonella

The Food and Drug Administration has shut down a peanut butter factory in New Mexico due to production of unsafe food. The Sunland factory, located in Portales, New Mexico, is the largest organic peanut butter producer. The popular store, Trader Joe's obtains its peanut butter from this factory.

Fox News reported that people in 20 states across the country have contracted salmonella due to the peanut butter. An outbreak linked to Sunland's peanut butter occurred in September 2012 and the factory voluntarily shut down its New Mexico based factory. Sunland planned to reopen its factory today, but the Food and Drug Administration shut down the factory for unsafe food production.

The Food and Drug Administration gained the power to shut down companies for unsafe food production in 2011 through a food safety law. This is the first time the agency has exercised its power. The company now has the burden of showing that its food is safe, before it can reopen.

A hearing will be held and the company will be inspected to determine if it is safe. Previously the company was inspected and 28 different instances of salmonella were found in the factory. The agency also discovered improper handling of food, unclean equipment and peanuts that were stored outdoors without being covered so that the peanuts were exposed to insects and birds.

After the outbreak this year, the Food and Drug Administration released results of inspections conducted in 2007, 2008, 2009, 2010, and 2011 stating that the company had unclean equipment and improper handling of food. Also, there is evidence - denied by the president of Sunland - that in the last three years, the company would send out products that had tested positive for salmonella through internal tests.

Very concerning now is that Sunland distributes not only to Trader Joe's, but also to Target, Safeway, Whole Foods and other national grocery store chains. When the outbreak of salmonella was reported, many of these grocery stores repackaged the Sunland products and sold them under their own company names. Thus, there is the potential that contaminated peanut butter and other nut products is still on the shelf.

Energy Drinks Reportedly Linked to Deaths

It was recently reported by the Marquette Tribune that certain energy drinks have been linked to multiple hospitalizations and several deaths (the full article is available here).  According to a report released by the Food and Drug Administration, the popular energy shot known as "5-Hour Energy" has been linked to 33 hospitalizations and 13 deaths (the full report from the FDA is available here).  The FDA report also names Monster and Rockstar energy drinks (which are marketed to the public as dietary supplements) as being linked to health problems in numerous cases across the United States. Common side affects noted by patients were flushing, increased heart rate, vomiting, heart attack, cardiac arrest, convulsions and death.  The report was careful to note that the incident reports made to the FDA sometimes contain incomplete information such as whether the individuals suffered from other medical conditions such as heart disease.

Drunk Driver Injures Four Children in Weekend Crash

A drunk driver injured four children in Mesquite, Nevada over the weekend. According to Fox 5 News, police arrived at the scene of the accident where bystanders were forced to physically restrain the driver as he attempted to flee (the full article is available here).  Fox 5 reports that the man struck two vehicles that were parked along a curb.  The children who range in ages between 1 and 5 years old were transported from the scene for treatment. One child had to be airlifted to Las Vegas due to the severity of her injuries.  A 33 year old Mesquite resident has been detained on suspicion of drunk driving, child endangerment, child restraint and other various traffic violations.

Update on Fungal Meningitis Outbreak and Las Vegas

According to  Las Vegas Action 13 News, the United States Food and Drug Administration has released a list of Las Vegas area medical practices that received potentially dangerous products from the  pharmacy linked to a deadly fungal meningitis outbreak.  According to the article (available here), the following medical practices received medications that were produced by the pharmacy during the recall period: 
  • The Cosmetic Surgery Center of Las Vegas
  • Shepherd Eye Surgicenter
  • The Weiland Group
  • Valley Hospital
  • Valley Hospital Medical Center
So far over twenty people have died and dozens more have been sickened as a result of being exposed to fungal meningitis, which has been linked to the New England Compounding Center's Framingham, Massachusetts facility.  The drugs which have been linked to the outbreak were a form of injectable steroid that is used to treat pain, including low back pain and joint discomfort.  Symptoms of fungal meningitis include fever, nausea, vomiting, stiff neck, sensitivity to light and altered mental status.  If you were treated at any of the above Las Vegas facilities and have any of the above symptoms you should seek medical attention immediately.

Sunscreen Recall after Reports of Users Catching Fire

Banana Boat Sunscreen has recalled its UltraMist sunscreen product after reports that five individuals throughout the United States and Canada have caught fire after applying the sunscreen. There are nearly two dozen formulations of the sunscreen that are being pulled off the shelves and Banana Boat is  instructing people to not use the UltraMist products.

According to the Las Vegas Sun, more than 20 million units of the sunscreen have been sold. According to USA Today, approximately a half-million bottles of sunscreen have been recalled. Thus, there is still a possibility that more people could be injured by this product. The error appears to be with the spray valve with over applies the product. Thus, after applying the product takes longer to dry and if the user comes into contact with a flame or a spark while the product is still wet, the product will ignite and the person will catch fire.

This is a voluntary recall by Banana Boat. Banana Boat has informed the Food and Drug Administration of this voluntary recall.

Meningitis Outbreak Gives Rise to a Lawsuit

As we previously blogged, a meningitis outbreak has occurred in this country. This is a serious national health concern that may affect local citizens in Nevada.

As reported this morning, a lawsuit has been filed related to the nearly 14,000 people could have been given pain injections tainted with meningitis. The outbreak of meningitis began last month with most of the victims appearing in Tennessee.  There have been 14 deaths related to this outbreak and the number of infected people is quickly increasing. As reported by Reuters, 32 people were reported infected on Wednesday and 169 on Thursday.

This outbreak is a national concern. Senator Richard Blumenthal has called for an investigation into the company who provided the injections. In fact, the senator is calling for a criminal investigation into the New England Compounding Center of Massachusetts, the company purportedly responsible for the injections. The New England Compounding Center of Massachusetts has issued a recall of all of its products on October 6, 2012. The company has also suspended its operating license and is cooperating with investigators.

According to the U.S. Center for Disease Control and Prevention, the tainted injections were shipped to 23 states. 11 states have confirmed cases of meningitis (Idaho, Florida, Indiana, Maryland, Michigan, Minnesota, New Jersey, North Carolina, Ohio, Tennessee, and Virginia). There have been deaths in six states. The medical community and federal government are still attempting to contact approximately 2000 people who received tainted injections and need to be tested immediately. Most of the patients received the injections for back pain, but now it is being discovered that these injections were also used for joint pain injections to places such as the knee or ankle.

Dr. Todd Weber of the CDC stated "We are not out of the woods yet[.]" At least 50 vials of the 17,000 that were produced have already been confirmed as infected. Furthermore, people can begin displaying symptoms within two weeks, but it may take several months.

It appears that the compounding pharmacy that provided this medication was violating state laws. Compounding pharmacies typically provide products that are not commercially available. According to the Massachusetts Department of Health, the New England Compounding Center of Massachusetts violated state law by doing large scale production of the steroids which are tainted.

A woman in Minnesota filed a lawsuit yesterday in relation to the outbreak. She received an injection and is now experiencing meningitis-like symptoms.

Steroids Linked to Fungal Meningitis Outbreak May Have Been Sent to Las Vegas, Nevada

The pharmacy linked to a deadly outbreak of fungal meningitis is believed to have sent its products to over 23 states including Nevada. The outbreak which has been linked to steroid injections has sickened over one hundred and killed at least eleven people.  According to NBC News, the steroids started being distributed on May 21, 2012, which is earlier than previously expected (the full article is available here, http://vitals.nbcnews.com/_news/2012/10/08/14297235-fungal-meningitis-deaths-now-at-11-119-cases-confirmed?chromedomain=dailynightly).  According to the Centers for Disease Control, fatalities have occurred in nine states and that 13,000 people may have been exposed to the disease.  The drug linked to the illnesses is methylprednisolone acetate, which is common used to treat patients for lower back pain.  The drug is often given to the elderly or victims of motor vehicle accidents.  The drugs have been traced to the New England Compounding Center, which is a single compounding pharmacy.  NBC News reports that the pharmacy has closed voluntarily, relinquished its state license and recalled all of its products.  According to the article, the drugs were distributed without preservatives that are meant to prevent fungi and bacteria from growing.  Patients who have been sickened by the outbreak suffer from flu like symptoms which often do not appear until several weeks after an injection.  Fortunately this form of outbreak is extremely rare and is not contagious.  Nevertheless, according to the Centers for Disease Control, the following symptoms have been reported among those infected with fungal meningitis:
  • fever
  • headache
  • stiff neck
  • nausea and vomiting
  • sensitivity to light
  • altered mental status

Las Vegas Streets


Very often in Las Vegas, it is reported that a pedestrian was struck by a car. Some factors that contribute to this could be that there are a high number of pedestrians that travel on some busy intersections and streets in the city. Furthermore, Las Vegas is open and running 24 hours a day. Thus, there are a large number of workers that get off at odd hours and are walking home on dark streets.

Many pedestrian injuries have been  reported including one recently about a young girl who was killed while walking in a crosswalk.  Also, a fatal motorcycle accident also resulted in a pedestrian injury.  There have been discussions by Las Vegas citizens about making the streets safer including editorials in the newspaper. Also, a task force that was run jointly by local law enforcement and the FBI was created by the city in an attempt to create safer streets. And while these attempts may have made the streets a little safer, unfortunately, many accidents and pedestrian deaths are still occurring. 

It is clear that further action is needed to make the streets of Las Vegas safe for pedestrians and motorist alike. However, in the mean time it is important to protect yourself. Intoxicated Driver Causes Fatal Accident at Las Vegas Bus Stop



As was reported by News Now in Las Vegas, four people were killed and several more were seriously injured while they waited at a bus stop this morning (the full article is available here, http://www.8newsnow.com/story/19533738/breaking-news-serious-accident-near-spring-mtn-decatur).  Initial reports indicate that the driver was traveling at a high rate of speed when he lost control of the vehicle and slammed into the bus stop where several people were waiting.  Law enforcement reported that the driver of the vehicle was injured but is expected to survive.  Initial reports also indicate that the driver was intoxicated at the time of the crash. 
According to the Centers for Disease Control, motor vehicle accidents are the leading cause of death among Americans aged 5-34.  Last year over 2.3 million Americans were treated in emergency rooms as a result of injuries suffered in motor vehicle accidents.  The economic impact of these accidents is estimated to be $70 billion for the year 2005 alone (the CDC article is available here, http://www.cdc.gov/motorvehiclesafety/).  One in three drivers involved in a motor vehicle accident were under the influence of alcohol.  In 2009, alcohol related accidents were responsible for nearly 11,000 deaths in the United States. 
According to the University of Nevada School of Community Health Services, Nevada's motor vehicle crash rate is among the highest in the nation.  In Nevada alcohol was related in 46% of all motor vehicle deaths (the full Nevada study is available here, http://health.nv.gov/PDFs/InjuryInNevada.pdf).  Many Nevada residents who are injured as a result of drunk drivers are often left uncompensated for their injuries.  Others who have lost a loved one as a result of a drunk driver never receive compensation for the loss through a wrongful death claim.

Insurance Company Claims Las Vegas Drivers Are Unsafe

According to an article written by Fox News Las Vegas, drivers in the Las Vegas area ranked as some of the most unsafe in the nation (the full article is available here, http://www.fox5vegas.com/story/19395083/vegas-low-on-safe-drivers-ranking).  The article relies on rankings prepared by Allstate Insurance Company.  According to Allstate, Las Vegas scored 138 out of the country's 200 largest cities.  Allstate claims that the average driver in Las Vegas will be involved in one accident every 8-9 years.  Notably Reno, NV scored as one of the safest cities in the United States. 
Having previously worked as an insurance defense attorney, I find Allstate's scores interesting for two reasons.  First, they partially explain why the insurance rates in Las Vegas are higher than other cities.  Expecting a greater number of claims in a geographical area, insurance companies raise their insurance rates to maximize profits.  Second and more importantly, because Allstate's study tends to show that Las Vegans are more likely to be involved in a greater number of accidents, Las Vegans are therefore more likely to be injured in a motor vehicle accident than residents of other cities. 
Most drivers have liability insurance in case they injure another driver.  Additionally, most drivers have uninsured/underinsured (UM/UIM) motorist coverage if they are injured by another driver who either has no insurance or their insurance policy is not enough to cover all of their damages.  Despite these protections, many insurance companies attempt withhold insurance policy funds, even in cases where their insured was clearly at fault.  Insurance companies will try to deny claims by arguing that the injured party's injuries were not caused by the accident or that the injured party was partially at fault.  Worse still, insurance companies often deny their own policy holder's claims to their UM/UIM coverage.  This creates a situation where an insurance policy holder is forced to sue their own insurance company in order to seek compensation for injuries they suffered through no fault of their own.  Unfortunately, these actions by insurers result in many drivers never receiving full compensation for their injuries.  Contacting an experienced personal injury attorney may be the only way driver's will ever see full compensation for their injuries.

$14.5 million settlement to brain injury victim

As was recently reported by Fox Business News (available here, http://www.foxnews.com/us/2012/08/22/145m-for-boy-brain-injury-from-metal-bat/), a $14.5 million dollar settlement has been reached in a lawsuit filed against baseball bat manufacturer Louisville Slugger.  According to the article, the Plaintiff was struck in the chest by a line drive while playing in a little league game in 2006.  After being struck by the ball, the child's heart stopped and he was left with permanent brain damage. Due to his injuries the Plaintiff (now 18) is unable to care for himself and requires 24 hour assistance.  According to the article the settlement funds will be used to provide for the Plaintiff's extensive future medical needs.  The parents of the Plaintiff hope that aluminum baseball bats will no longer be marketed to little league teams due to the risk of injuries that they carry.

Uninsured/Underinsured Motorist Coverage.

As was recently reported by Victoria Cavaliere in the New York Daily News, comedian Matt Fisher claims that his sister Katie's insurance company, Progressive Insurance, defended her killer in court.  According to the article (available here, http://www.nydailynews.com/news/national/comedian-progressive-insurance-defended-sister-underinsured-killer-avoid-paying-claim-article-1.1135907), Mr. Fisher's sister was tragically killed in a motor vehicle accident when a driver ran a red light and struck her car.  The article claims that the Fisher family was forced to bring a lawsuit against the driver in order to recover the Uninsured/Underinsured (UM/UIM) insurance policy that Ms. Fisher had through Progressive.  Mr. Fisher claims that Progressive defended the driver in court, which essentially means that Ms. Fisher's insurance company defended her own killer in court against her survivors.  Progressive is actively denying the claims made by the Fisher family (as seen in a follow up article available here,  http://www.nydailynews.com/news/justice-story/progressive-denies-lawyers-clear-man-killed-comedian-sister-article-1.1136648). 

Insurance companies will aggressively seek to deny claims made under UM/UIM coverage.  In Nevada insurers must offer UM/UIM coverage on a state approved form.  If an insurer fails to offer UM/UIM coverage, the coverage amount automatically raises to the amount of liability coverage on the policy.  Ippolito v. Liberty Mut. Ins.
